Terms & Conditions

These terms and conditions govern the agreement between the artist, SAP ART and the client (the buyer) when purchasing a pet portrait. By placing an order or commission the Artist, the client agrees to be bound by the following terms and conditions. If you do not agree to these terms, please do not use SAP ART'S services.

Price List

The price list is subject to change but the portrait prices are as per the current published portrait price list on the website, regardless of any older business cards or leaflets you may have. The pricing includes labour costs and materials. Framing and postage are an additional cost. 

The Artists’ prices are ‘From’ a price as each portrait varies in the Artists time depending on the Clients specific requirements. Please fill out the submission form on the website to enter your exact details. The Artist will receive your request and contact you ASAP with a quote. By filling out a submission form, this will expedite the lead time for the Artist to process your request.

Quote

A rough quote is provided as each commission varies in the Artists time. The time it takes to complete a commission is dependant on factors like, how many subjects, chosen size, images, the breed or type of animal, chosen style (realistic or colourful), and whether its framed or unframed. Therefore the provided quote is an estimate based on the information provided at the time of booking. The final cost may vary depending on the actual scope of work required, therefore the quote could slightly increase or decrease after completing the painting. The Artists time really does vary and the estimated quote is not 100% guaranteed.

Reference Photos

The Client must provide clear, high resolution reference photos of their pets. Please provide a selection of photos for the Artist to choose from, the more the better. This allows the Artist can depict details in other photos which are not seen clearly in your chosen reference photo. Please remember the Artist isn’t familiar with your furry friend and their characteristics so expect the finished commission to be a copy of your reference photo. If the image isn’t clear, the Artist will try their best efforts to make the portrait as realistic as possible. 

Clients must have the necessary rights and permissions to share the reference photos with the Artist and will not be held responsible for any copyright infringement issues.

Deposit

A booking fee will be issued upon agreement on the quote given and the Client must pay a 50% deposit of the lowest figure given in the rough quote. For example, if the Artist quotes £220 - £250, a 50% deposit of £220 is taken, so a £110 booking fee is required to secure their place on the waiting list. This payment is non-refundable after 7 days of booking. Payment can be taken either by PayPal for international payments or Credit Card via bank transfer for UK payments. Local orders can be paid by cash.

Cancellation & Refunds

You have a 7 day money back guarantee period from the date of your booking in which you may cancel your order and receive your deposit back in full. After this period, your booking fee becomes non-refundable and will be retained by the Artist to cover the Artists time, administration costs, labour and materials used. If the Artist is unable to complete the commission for any reason, the Client will be refunded the full deposit amount.

Portrait Completion Timescale

The Artist will provide an estimated completion date for the portrait upon booking your commission. However this is not guaranteed but every effort will be made to meet this. The Artist allows 1-4 weeks to complete each portrait and focus’ on one commission at a time. She works on a first come first serve basis and waiting times can take up to 6 months, so please be mindful of this when ordering for a specific date and make it clear at the time of booking. Please order early, especially for the Christmas period as September - December are my busiest times. Remember to factor Christmas postal timings too.

Artistic Interpretation

The Artist has the creative freedom to interpret the reference photos and capture the essence of the pet in their own artistic style whether the Client chooses a colourful or realistic style. Minor artistic liberties may be taken to enhance the composition or overall quality of the artwork, especially if the quality of the reference photos are poor.

Changes & Alterations

The Client can request minor changes or alterations to the artwork during the creation process. Major changes or modifications to the artwork after completion may incur additional charges. Modifications cannot be added once the painting is framed and packaged.

Framing

Clients must make it clear to the Artist as to what frame they opt for. The Artist uses IKEA frames to frame her artwork - if there’s a particular frame elsewhere that the Client likes, please let the Artist know and this can be ordered in for you. Framing comes at an additional cost and will be calculated at the time of booking depending on your request. The Artist is not responsible for any frame impairments but will always ensure that each painting is framed in good condition and shipped securely.

Final Payment

The final artwork will be forwarded to the Client upon receipt of the remaining balance. If you’re 100% satisfied with the result, the outstanding balance is required before your portrait is dispatched. You can do this in full or in installments, however, the portrait will not be delivered until all balances have been fully paid. Prints must be paid off in full at the time of ordering. Payment can be taken either by PayPal for international payments or bank transfer for UK payments. Local orders can be paid for with cash upon collection or drop off.

Exchange Rates

Any currency converter used is for estimation and information only. Exchange rates will be calculated either by Paypal or as per the current exchange rates during the time of payment. SAP ART cannot be held responsible for currency rate changes.

Delivery & Postage

Shipping costs depend on the size and weight of the portrait (framed or unframed) and also the destination. This will be calculated at time of booking. Clients are responsible for providing the accurate shipping information. If the item is a gift, it can be shipped directly to the recipient. All portraits are shipped securely and sent via Royal Mail Next Day Special Delivery or International Signed for. The Artist will forward a tracking reference number to track your parcel and if any damage is caused in transit, the parcel is insured. Most items are shipped within 3-5 business days from portrait completion. If a delivery incurs any import tax, VAT, or duties the Client is solely responsible for these payments. SAP ART cannot be held responsible for any additional charges which may occur.

Care & Maintenance

​The Client agrees to handle the artwork with care to ensure its preservation. An Artwork Aftercare Guide is included and each portrait is sprayed with multiple coats of UV protection and Varnish to further enhance its longevity. The Artist is not responsible for any damage to the artwork after delivery so its advisory to follow the Aftercare Guide provided.

Copyright & Ownership

The Artist retains full copyright and ownership of all artwork created. The Client may not reproduce or sell the artwork without the explicit written permission of the Artist.

Promotional Use

The Artist reserves the right to use images of the commissioned artwork for promotional purposes (e.g. portfolio, website, social media) unless otherwise agreed in writing with the Client.

Privacy Policy

The Artist will treat all client information and photographs provided as confidential and will not share them with third parties without explicit consent.

Liability

The Artist will not be liable for any loss, damage, or injury arising from the use of the commissioned artwork. The Client agrees to indemnify the Artist against any claims from third parties regarding the artwork's creation or use.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts in the United Kingdom.
